{"id":22417,"date":"2023-10-26T07:00:19","date_gmt":"2023-10-26T05:00:19","guid":{"rendered":"https:\/\/mwehle.eu\/wp\/?p=22417"},"modified":"2023-10-26T07:00:19","modified_gmt":"2023-10-26T05:00:19","slug":"human-rights-watch-on-icc-investigation-on-israel-palestine","status":"publish","type":"post","link":"https:\/\/www.wehle.ee\/wp\/?p=22417","title":{"rendered":"Human Rights Watch on ICC Investigation on Israel-Palestine"},"content":{"rendered":"<p><a href=\"https:\/\/www.hrw.org\/news\/2023\/10\/25\/countries-should-back-icc-investigation-israel-palestine\" target=\"_blank\" rel=\"noopener\">Human Rights Watch<\/a>:<\/p>\n<blockquote><p>On October 10, the United Nations Independent International\u00a0<a href=\"https:\/\/www.ohchr.org\/en\/hr-bodies\/hrc\/co-israel\/index\" target=\"_blank\" rel=\"noopener noreferrer\">Commission of Inquiry<\/a>\u00a0on the Occupied Palestinian Territory\u00a0<a href=\"https:\/\/www.ohchr.org\/en\/press-releases\/2023\/10\/commission-inquiry-collecting-evidence-war-crimes-committed-all-sides-israel\" target=\"_blank\" rel=\"noopener noreferrer\">noted<\/a>\u00a0there was \u201cclear evidence\u201d of\u00a0<span class=\"onomasticon onomasticon-cursor-default\" tabindex=\"0\" title=\"war crimes\" data-tooltip=\"War crimes are serious violations of international humanitarian law committed by individuals with criminal intent. Criminal intent means the violation was carried out deliberately or recklessly. Individuals who order, assist, and aid and abet offenses are also responsible for war crimes.\" aria-label=\"Explain glossary term war crimes\" data-once=\"enable_tooltips\">war crimes<\/span>\u00a0in Israel and Gaza and that it would be sharing information with relevant judicial authorities, especially the ICC.<\/p>\n<p>Despite this, Human Rights Watch is aware of only three ICC member countries\u2014<a href=\"https:\/\/twitter.com\/LiechtensteinUN\/status\/1712863194480300324\" target=\"_blank\" rel=\"noopener noreferrer\">Liechtenstein<\/a>,\u00a0<a href=\"https:\/\/press.un.org\/en\/2023\/sc15451.doc.htm\" target=\"_blank\" rel=\"noopener noreferrer\">Switzerland<\/a>, and\u00a0<a href=\"https:\/\/www.dirco.gov.za\/south-africa-condemns-the-bombing-of-the-ahli-arab-hospital\/\" target=\"_blank\" rel=\"noopener noreferrer\">South Africa<\/a>\u2014that have made clear statements referring to the ICC and the current hostilities.\u00a0<a href=\"https:\/\/www.breakingnews.ie\/israel-hamas\/tanaiste-calls-for-independent-investigation-into-gaza-hospital-attack-1540922.html\" target=\"_blank\" rel=\"noopener noreferrer\">Ireland\u2019s<\/a>\u00a0foreign minister referenced the role of the court in media comments.\u00a0For others, it appears the ICC may be the judicial elephant in the room.<\/p>\n<p>All ICC members should urgently voice their support for the court\u2019s role.<\/p>\n<p>The response to date stands in\u00a0<a href=\"https:\/\/www.hrw.org\/news\/2023\/10\/19\/international-humanitarian-law-applies-all-states\">stark contrast<\/a>\u00a0to\u00a0<a href=\"https:\/\/www.hrw.org\/news\/2023\/03\/29\/ukraine-international-justice-response\">other crises<\/a>, including\u00a0<a href=\"https:\/\/www.hrw.org\/europe\/central-asia\/ukraine\">Ukraine<\/a>, a non-ICC member country. After the full-scale Russian invasion in February 2022, the\u00a0<a href=\"https:\/\/www.icc-cpi.int\/news\/statement-icc-prosecutor-karim-aa-khan-qc-situation-ukraine-i-have-decided-proceed-opening\" target=\"_blank\" rel=\"noopener noreferrer\">ICC prosecutor<\/a>\u00a0spoke out about the court\u2019s critical role, and an unprecedented number of mostly European ICC member countries\u00a0<a href=\"https:\/\/www.hrw.org\/news\/2022\/03\/02\/ukraine-countries-request-icc-war-crimes-inquiry\">asked him to open<\/a>\u00a0a Ukraine investigation. Even the United States, another non-ICC member, has\u00a0<a href=\"https:\/\/www.nytimes.com\/2023\/07\/26\/us\/politics\/biden-russia-war-crimes-hague.html\" target=\"_blank\" rel=\"noopener noreferrer\">expressed strong support<\/a>\u00a0for the ICC&#8217;s role in Ukraine.<\/p>\n<p>The ICC prosecutor has not\u00a0<a href=\"https:\/\/www.hrw.org\/news\/2023\/10\/13\/israel\/palestine-letter-prosecutor-international-criminal-court\">proactively issued a public statement<\/a>\u00a0reminding Israel and Palestinian armed groups of their obligations under international law and of the court\u2019s mandate to investigate their actions. The court\u2019s voice is urgently needed to help prevent further mass atrocities.<\/p>\n<p><a href=\"https:\/\/www.hrw.org\/news\/2023\/01\/27\/long-yet-still-uneven-arc-international-justice\">Double standards<\/a>\u00a0in victims\u2019 access to accountability are unacceptable.<\/p><\/blockquote>\n<p>The word &#8222;unacceptable&#8220; in statements like this always catchs my eye, as do words like &#8222;insist&#8220; and &#8222;demand&#8220;. When we are observing states commit mass murder what does it mean to &#8222;accept&#8220; or &#8222;refuse to accept&#8220; what we are seeing? Gaza absolutely does not enter into the daily social conversation of my coworkers. In the summer of 2022 several coworkers in an international team responded to my questions about Ukraine by saying they didn&#8217;t talk about the subject out of concern for a Ukrainian colleague&#8217;s sensitivities. There was universal agreement that Russia was &#8222;wrong&#8220;, however, just as in German public life today it is without question that Israel is a victim and &#8222;deserves our full support&#8220;.
